If you do not belong to a group health plan, such as the C&MA Health Plan, and you church reimburses you for health insurance premiums or other costs, please be aware of new Affordable Care Act penalties for certain reimbursement arrangements. The penalties are $100 per day, per employee, even if the amounts reimbursed are reported to the employees as taxable compensation. Many smaller churches are breaking this rule simply by paying for an individual health insurance policy purchased by a staff member. Churches also break this rule if they reimburse staff for out-of-pocket expenses, such as deductibles, if they are not part of a group health plan that uses an allowed arrangement such as a FSA, HSA or HRA.
